twogirlsonebillboard.com is operated by Dodo Media LLC ("we", "us"). By using the site or buying a placement you agree to these terms, to the Content Rules, and to the Refund Policy.
What you are buying
A takeover: your brand name, headline, icon and link displayed on the billboard shown on the homepage, plus a permanent entry on the leaderboard at the price you paid.
The price is the current price plus one cent. It is shown to you before you pay and it is what you are charged. When your payment succeeds your placement goes live immediately.
How long you hold it
Every takeover comes with a guaranteed minimum, shown to you before you pay, which scales with the price — a minute at the bottom of the ladder, up to ten minutes at a thousand dollars. During that window nobody can take the board from you.
After it expires you keep the board for free until somebody pays a penny more. That could be an hour later or a second later. There is no maximum, and equally no promise of any duration beyond your guaranteed minimum.
When you are outbid you move down the leaderboard and stay there permanently. Your entry continues to be shown and continues to be clickable.
Your content
You keep ownership of everything you submit. You grant us a non-exclusive, worldwide, royalty-free licence to display it on the site, on the leaderboard, and in screenshots or promotional material about the site, for as long as the site exists.
You confirm you have the right to use everything you submit, including any logo, trademark or image, and that displaying it does not infringe anyone's rights.
Content must comply with the Content Rules. We may remove anything that does not, immediately and without a refund, and we may remove anything else at our discretion.
Traffic, clicks and numbers
We do not guarantee any traffic, clicks, impressions, or outcome. You are buying a placement, not a result.
The visitor and click figures shown on the site are measured by DataFast, a third-party analytics provider, and are published on a dashboard you can inspect yourself. They are provided as-is. They exclude traffic DataFast judges to be automated and traffic from visitors whose browsers block analytics, so they undercount rather than overcount. We do not warrant their accuracy and you should not rely on them as audited figures.
Payment
Payments are processed by Stripe. We never see or store your full card details. You are responsible for any taxes arising from your purchase. Prices are in US dollars.
The board is claimed before your card is charged, so if somebody beats you to it you are not charged at all.
The site is provided as-is
The site and the service are provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the site will be uninterrupted, timely, secure, or error-free, or that the billboard will be visible at any given moment. Use it at your own risk.
Limitation of liability
To the maximum extent permitted by law, Dodo Media LLC and anybody connected with it will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunity, arising from your use of the site — whether or not we were told such damages were possible.
Our total liability for any claim relating to the site or a placement is limited to the amount you actually paid us for that placement.
Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you. Nothing here limits liability for fraud or for anything that cannot lawfully be limited.
Ending things
We may suspend or discontinue the site at any time. We may refuse or remove any placement. If we remove a placement for breaching these terms or the Content Rules, no refund is due.
If we discontinue the site entirely while your guaranteed minimum window is still running, we will refund that placement.
Changes
We may update these terms. The version in force is the one published here at the time you buy. Material changes will be reflected in the "last updated" date above.
Law
These terms are governed by the laws of the State of California, United States, without regard to conflict of law rules. Any dispute will be brought in the state or federal courts located in California, and you and we each consent to their jurisdiction.
